斯里兰卡红茶又名锡兰红茶，是世界上出口量最大的国外红茶之一，近年来逐渐在国内市场流行，深受不少消费者的喜爱。
Ceylon tea, also known as Sri Lankan tea, is one of the most exported foreign teas in the world. In recent years, it has gradually become popular in the domestic market and is loved by many consumers.
由于这种茶叶多是从国外进口，大多消费者往往会选择通过网购的方式入手，因此，容易成为不法分子侵权假冒的对象。
Since this tea is mostly imported from abroad, most consumers tend to purchase it online, making it an easy target for counterfeiters and infringers.
"量贩"茶叶假冒进口"精品"
Bulk Tea Counterfeited as "Premium" Imported Product
从上级供应商处进购茶叶，再通过开设的网店进行分销，2015 年以来，接触到某知名斯里兰卡红茶品牌后，许某某就一直经营着一家分销该品牌茶叶的公司。
Since 2015, Xu had been operating a company distributing a well-known Sri Lankan tea brand after purchasing tea from suppliers and selling through online stores.
2019 年 5 月，又一热门款茶叶断货后，为了维持销售量赚取更多利润，许某某动起了"歪脑筋"。
In May 2019, when another popular tea product was out of stock, Xu came up with illegal ideas to maintain sales and profits.
将源头厂家固定供应给餐饮渠道，且价格相对便宜的量贩茶叶拆分后，装入未经授权私自印制的假冒小包装，再以精选红茶的高价对外销售。
He repackaged bulk tea meant for catering channels into unauthorized counterfeit packaging and sold them as premium tea at high prices.
临期正品"焕新"上架
Repackaging Near-Expiry Products as "New"
许某某的公司挑选出临近过期的茶叶品类，通过重新印制一批假冒该类茶叶的外包装，印上新的生产日期和保质期后，重新封装，以新鲜茶叶重新上架。
Xu's company selected near-expiry tea products, reprinted counterfeit packaging with new production dates, and repackaged them as fresh tea.
自制"爆款"小罐茶贴标出售
Creating Counterfeit "Popular" Small-Pack Tea
许某某还自创"爆款"进行销售。近年来市场爆火的小罐茶备受关注，许某某自然也没有放过这个"商机"。
Xu also created counterfeit "popular" products. Noticing the market trend of small-pack tea, he seized this "business opportunity".
经检察机关审查，2019 年 5 月至 2020 年 9 月，许某某共计采购假冒品牌标签 36 万余张，外包装 30 余万个，累计销售价值 499 万余元，非法获利人民币 6 万元。
According to procuratorial review, from May 2019 to September 2020, Xu purchased over 360,000 counterfeit labels and 300,000 packages, with total sales reaching 4.99 million yuan and illegal profits of 60,000 yuan.

Prosecutor's Statement
注册商标受法律保护，未经注册商标所有人许可，擅自制造带有他人注册商标标识的包装盒，属于侵犯知识产权的行为，情节严重的，将被追究刑事责任。
Registered trademarks are protected by law. Unauthorized manufacturing of packaging with others' registered trademarks constitutes intellectual property infringement and may lead to criminal liability in serious cases.
