December 1st, Beijing Time - A federal judge in Montana issued a significant ruling, blocking the first statewide ban on TikTok in the US. This decision is seen as a major victory for TikTok in its legal battles in America.
美国地方法官唐纳德·莫洛伊(Donald Molloy)在初步裁决中指出,蒙大拿州的禁令"很可能违反了宪法第一修正案"。法官认为,该禁令明显不是为了保护该州消费者权益。
US District Judge Donald Molloy stated in the preliminary ruling that Montana's ban "likely violates the First Amendment". The judge concluded the ban was clearly not designed to protect consumers in the state.
TikTok目前在美国拥有超过1.5亿用户,其中蒙大拿州超过三分之一的居民都在使用该平台。法官莫洛伊强调:"如果TikTok被封禁,用户将被剥夺通过他们喜爱的方式自由交流的权利。"
TikTok currently has over 150 million users in the US, with more than one-third of Montana's population using the platform. Judge Molloy emphasized: "If TikTok were banned, users would be deprived of their right to freely communicate in the way they prefer."

On May 17 this year, Montana's governor signed the TikTok ban, which was scheduled to take effect statewide on January 1, 2024. TikTok immediately launched a legal challenge, accusing the ban of violating multiple laws including the First Amendment and federal preemption.
美国媒体指出,这是美国政府针对TikTok的"围剿"行动遭遇的又一次挫折。就在蒙大拿禁令被叫停前一天,印第安纳州一名法官也驳回了该州针对TikTok的诉讼。
US media noted this is another setback in the government's "crackdown" on TikTok. Just one day before the Montana ban was blocked, a judge in Indiana also dismissed the state's lawsuit against TikTok.

TikTok stated in a declaration: "We're pleased the judge rejected this unconstitutional law. Hundreds of thousands of Montanans can continue to express themselves, earn a living, and find community on TikTok."
